Factional leader of the party, Ahmed Makarfi, had approached the court to dissolve Sheriff's faction. The three presiding judges unanimous ruled in favor of Sheriff today.
The Court of Appeal sitting in Port Harcourt, Rivers State, on Thursday affirmed Sen Ali Modu Sheriff, as the authentic National Chairman of the Peoples Democratic Party, PDP.
The three-man panel of judges in a unanimous decision agreed that the former Borno State Governor is the authentic National Chairman of the party.
The party had inaugurated the committee following the alleged expiration of the tenure of its embattled factional National Chairman, Sen Ali Modu Sheriff.
Despite the existence of the Makarfi-led Committee, Sheriff has continued to maintain that he remained the authentic leader of the party.

A Court of Appeal sitting in Port Harcourt, Rivers State Friday
confirmed former Borno State governor Senator Ali Modu Sheriff as the
national chairman of the People’s Democratic Party (PDP).
In doing so, the appellate set aside a Federal High Court judgement
delivered by Justice Mohammed Liman which recognised Senator Ahmed
Makarfi as the chairman of the party.
Justice Liman in his judgment said that the National Convention of
the PDP held in Port Harcourt in 2016 was lawfully conducted in
accordance with the party’s constitution and guideline and that Ali Modu
Sheriff’s led executive was lawfully dissolved during the national
convention.
Ali Modu Sheriff was all smiles as he returned to his home for a long rest after a stressful day. The Ahmed Makarfi faction has decided to drag him to the Supreme Court over the leadership tussle.

following the victory of the Ali Modu Sheriff in the appellate court.

The Makarfi led PDP will challenge the ruling of the Port-Harcourt Court of Appeal at the Supreme Court as anticipated. This is in accordance with the statement posted on her official twitter handle.
The statement read thus:
1. Two out of the 3 man Justices of the Appeal
Court gave a scanty judgment in favour of Senator Ali Modu Sheriff while
one for Makarfi
2. The Judgment has finally shown that the ruling Party, the APC is out to create a one party state in the country.
3. The Party is proceeding immediately to the Supreme Court to file an appeal against the ruling of today's appeal court judgment
Senators Ahmed Makarfi and Ali Modu Sheriff have tested their legal
muscles through various litigations in many courts in Lagos, Abuja and
Port Harcourt, with each getting favourable orders and directives with
the attendant effect on stability in the party.
Chieftains of the party from the two sides had at various fora
expressed readiness to abide by the outcome of the appeal court verdict
with a view to bringing lasting peace in the party.
A Federal High Court in Port Harcourt had last year gave legitimacy
to Makarfi as the chairman of the party, while another court of
coordinate jurisdiction in Abuja, headed by Justice Okon Abang, had
ruled that Sheriff should be recognised as the chairman.
The PDP has not been able to play the role of leading opposition to
the ruling All Progressives Congress (APC) because of the crisis
ravaging it from within.
Meanwhile, a former Aviation minister, Femi Fani Kayode has reacted
to Ali Modu Sheriff's victory at appeal court. According to him, the
decision of the Appeal court is a "victory" for President Buhari.

Former aviation Minister, Femi Fani-Koyde has hinted on leaving the Peoples Democratic Party, PDP, for embattled factional National Chairman of the Party, Sen Ali Modu Sheriff.
The former Presidential campaign spokesperson in a series of tweet on his twitter handle wrote: “The C of A decision is absurd. It is time for us to gut the PDP, leave its carcass for the treacherous mole called Sheriff and form a new party.”
Recall that the Appeal Court sitting in Port Harcourt, Rivers State had earlier today ruled in favour of the former Borno State Governor.
